Client Terms & Conditions
ABOUT US
HYPNO AUSTRALIA PTY LTD, trading as Hypno Australia (referred to as “we, our or us”) and THE CLIENT (referred to as “you or your”) acknowledge and agree that each of the provisions set out below form part of the agreement between us and you. Your use of the products and services we provide to you are subject to and governed by these Client Terms and Conditions.
WARRANTIES
Before proceedings with our products and services, you warrant to us that you acknowledge and agree that:
Hypnotherapy is a complementary therapy, and is not to be used as a replacement to modern medicine, or to replace the advice of a licensed/registered doctor, psychologist or other medical professional(s). Recommendations made by us are not intended to be a substitute for the diagnosis and care of a qualified physician or doctor.
YOU must complete all tasks set by us, and you must be committed to stopping the problem for which you are undertaking hypnotherapy so that you can achieve the best result from the hypnotherapy program.
IF YOU suffer from a mental health disorder, ensure you have consulted with your licensed/registered doctor, psychologist or medical professional who has given you a copy of a medical clearance letter for the purposes of hypnotherapy. You will produce the medical clearance letter to us upon our request. You understand that people with mental health disorders, including, but not limited to, schizophrenia, bipolar and psychosis, are advised against hypnotherapy until cleared by a licensed/registered doctor, psychologist or other medical professional(s) by way of a medical clearance letter.
YOU must inform us if you have been medically diagnosed with epilepsy prior to listening to any audio files provided by us.
YOU will not listen to any audio files while driving or operating heavy machinery.
YOU will ensure that you are completely awake prior to driving or performing any activity that may require your concentration.
YOU acknowledge that you are over 18 years of age.
We warrant that founders, Glen Pertzel and Katie Manser:
ARE certified hypnotherapists and hold the relevant qualifications and certifications to provide strategies and tools to assist with behavioural improvements and lifestyle enhancements to overcome barriers to success.
WILL only act in your best interests and within their scope of skills, expertise and experience.
WILL endeavour to refer you to a licensed service provider, should they be unable to provide the product or services required to assist you to meet your goals.
MATERIALS PROVIDED
We provide you with our products and services in various ways, including live online hypnotherapy sessions, in person hypnotherapy sessions and online hypnotherapy. In the course of providing our products and services, we will make available online materials, voice recordings, video recordings, live streams, workbooks and additional resources that are necessary or appropriate (our Materials).
You acknowledge and agree that we own all Intellectual Property created by us in connection with the products and services that we provide to you, that exist now or may come into existence in the future. Intellectual Property means and includes trademarks, patents, copyrights, processes, registered designs or other similar rights or any right to apply for registration of any of the former.
You acknowledge and agree that all Materials provided to you, whether or not they contain Intellectual Property rights capable of protection, are and will remain the sole and exclusive property of us. Payment for our services and products does not give you an interest, right, title or ownership to the Materials, subject to the limited license which we allow you to use those Materials.
You will not use, copy, distribute, reproduce, sell, resell, transmit, exploit or disclose any Materials, including logins, links, usernames or the like that provide you with access to our Materials, without our prior written permission. You will ensure that any unauthorised access to and use and copying of the Materials cannot occur.
PAYMENT
You agree and acknowledge that the payment made by you to us for the products and services that we provide to you is a non-refundable fee for our skills, expertise and experience in the area of hypnotherapy. Payment is not subject or conditional upon you achieving the results that you wish to achieve.
If we allow you to make payment by way of a payment plan or part payments, you must ensure the funds required are available in your nominated account at least 1 business day prior to the date the monies are expected to be debited from your nominated credit card, debit card or bank account.
PRIVACY
We collect personal information that is necessary to allow us to provide you with our products and services. We are committed to ensuring that the information you provide is secure. We will not write down any credit card details that you provide to us and, will only do so with your authority and only if it is necessary that we do, in which case we will destroy those details in a safe manner.
We also collect and use the personal information for the purpose of contacting and communicating with you and for our internal record keeping and for marketing. We are committed to ensuring that the information you provide to us is secure.
If you believe that any information we hold pertaining to you is inaccurate, out of date, incomplete, irrelevant or misleading, please contact us. We rely upon you advising us when your personal information changes. We will endeavour to promptly correct any information found to be inaccurate, incomplete or out of date.
If you do not want to provide us with personal information, you do not have to do so, however it may affect your use of our products and services.
AGREEMENT
By purchasing our products and services, you acknowledge and agree to comply with the terms and conditions contained in these Client Terms and Conditions and you will indemnify us fully against all liabilities, costs and expenses which we may incur as a consequence of your failure to comply with these Client Terms and Conditions.
