HYPNO AUSTRALIA PTY LTD (referred to as “we, our or us”) and THE CLIENT (referred to as “you or your”) acknowledge and agree that each of the provisions set out below form part of the agreement between us and you. Your use of the products and services we provide to you are subject to and governed by these Client Terms and Conditions.

WARRANTIES

Before proceedings with our products and services, you warrant to us that you acknowledge and agree that:

Meditation is a complementary therapy, and is not to be used as a replacement to modern medicine, or to replace the advice of a licensed/registered doctor, psychologist or other medical professional(s). Recommendations made by us are not intended to be a substitute for the diagnosis and care of a qualified physician or doctor.

MATERIALS PROVIDED

We provide you with our products and services in various ways. In the course of providing our products and services, we will make available online materials, voice recordings, video recordings, live streams, workbooks and additional resources that are necessary or appropriate (our Materials).

You acknowledge and agree that we own all Intellectual Property created by us in connection with the products and services that we provide to you, that exist now or may come into existence in the future. Intellectual Property means and includes trademarks, patents, copyrights, processes, registered designs or other similar rights or any right to apply for registration of any of the former.

You acknowledge and agree that all Materials provided to you, whether or not they contain Intellectual Property rights capable of protection, are and will remain the sole and exclusive property of us. Payment for our services and products does not give you an interest, right, title or ownership to the Materials, subject to the limited license which we allow you to use those Materials.

You will not use, copy, distribute, reproduce, sell, resell, transmit, exploit or disclose any Materials, including logins, links, usernames or the like that provide you with access to our Materials, without our prior written permission. You will ensure that any unauthorised access to and use and copying of the Materials cannot occur.

PAYMENT

You agree and acknowledge that the payment made by you to us for the products and services that we provide to you is a non-refundable fee.
